Acceptance of Terms
By accessing and using Pactum ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
Service Description
Pactum is a mobile application that allows you to write and schedule letters to your future self for delivery at a specific date and time. The Service includes features such as letter composition, scheduled delivery, push notifications, timeline viewing, and letter management.
The Service is provided for personal, non-commercial use only. You may not use Pactum for any commercial purpose or in any way that violates applicable laws or regulations.
User Accounts and Eligibility
To use Pactum, you must create an account. By creating an account, you represent and warrant that:
- You are at least 13 years old (or 16 if you reside in the European Economic Area)
- You have the legal capacity to enter into this agreement
- All information you provide is accurate, current, and complete
- You will maintain the accuracy of such information
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your account information remains current
You may not share your account credentials or allow others to access your account. You are solely responsible for any consequences of unauthorized access resulting from your failure to keep your credentials secure.
Subscription and Payment Terms
Pactum offers both free and premium subscription tiers:
- Free Trial: Includes 1 letter to test the experience
- Premium Subscription: $9.00 USD per year for unlimited letters and advanced features
Billing and Renewal:
- Premium subscriptions automatically renew at the end of each billing period unless cancelled
- You will be charged through your Apple App Store or Google Play Store account
- The subscription fee will be charged within 24 hours prior to the end of the current period
- Subscriptions may be managed and auto-renewal may be turned off in your app store account settings
Cancellation and Refunds:
- You may cancel your subscription at any time through your app store account settings
- Cancellation will take effect at the end of the current billing period
- No partial refunds will be provided for unused portions of a subscription period
- Refund requests are subject to Apple App Store or Google Play Store refund policies
- We reserve the right to issue refunds on a case-by-case basis at our discretion
Price Changes:
We reserve the right to change subscription pricing at any time. Price changes will be communicated to you at least 30 days in advance via email. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.
User Content
You retain all rights to the letters and content you create in Pactum. By using the Service, you grant us a limited license to store and deliver your content as necessary to provide the Service.
You are solely responsible for the content you create and share. You agree not to use the Service to:
- Share illegal, harmful, or offensive content
- Harass, threaten, or harm others
- Violate intellectual property rights
- Distribute spam or malware
- Impersonate others or misrepresent your identity
Service Availability
We strive to provide reliable service, but we do not guarantee uninterrupted access. We may:
- Perform maintenance and updates
- Modify or discontinue features
- Suspend service for technical or security reasons
While we make reasonable efforts to deliver letters at scheduled times, exact timing cannot be guaranteed due to technical limitations.
Termination
You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms of Service. Upon termination, your access to the Service will cease, and your data will be deleted according to our Privacy Policy.
Intellectual Property
The Pactum app, including its design, code, features, and branding, is owned by Pactum and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the maximum extent permitted by applicable law, Pactum disclaims all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding the accuracy, reliability, or completeness of the Service
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding the delivery of letters at exact scheduled times
We do not guarantee that the Service will meet your specific requirements or that any errors will be corrected. You use the Service at your own risk.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PACTUM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to or alteration of your transmissions or data
- Statements or conduct of any third party on the Service
- Any other matter relating to the Service
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Pactum and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms of Service
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you submit through the Service
Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Most disputes can be resolved informally. If you have a dispute with us, you agree to contact us first at austin@getpactum.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally within 60 days.
If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except for disputes that may be brought in small claims court.
YOU AND PACTUM AGREE THAT ANY CLAIMS WILL BE BROUGHT ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California and the federal laws of the United States, without regard to conflict of law provisions.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you hereby irrevocably consent to personal jurisdiction and venue in such courts.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pactum regarding the Service and supersede all prior agreements and understandings, whether written or oral.
Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the app. Continued use of the Service after changes constitutes acceptance of the updated terms.
